Consumer Stocks Mixed Pre-Bell

Consumer shares were mixed ahead of the opening bell Friday. In consumer stocks news, Wal-Mart Stores (WMT) and Amazon.com (AMZN) and other retailers have been sued by Run-DMC for selling products that traded on the rap group’s name without permission, Bloomberg reported, citing a court filing in the Southern District of New York. The report said the suit alleges the retailers are “advertising, selling, manufacturing, promoting and distributing multiple products” in the group’s trademarked name.”

And, Ark Restaurants (ARKR) late Thursday reported a weaker fiscal Q4, with both lower earnings and revenues. Net income in the quarter ended Oct. 1 was $0.28 per diluted share, down by half from last year’s $0.57 per diluted share. Revenues dropped to $38.5 million from $40.6 million. Company-wide same store sales decreased 7.0%.
